This is a major blow for Joe Biden’s ATF.
They were forced to back down by a ruling that completely blindsided them.
Now they are scrambling to find another way to grab guns.
The ATF likes to think of themselves as a schoolyard bully, but after a ruling from a judge they are suddenly on their heels in a way they never expected to be.
Their efforts to “close the gun show loophole,” or in plainer terms, criminalize ordinary Americans who sell or transfer guns, were shut down in multiple states by a federal judge.
They were hoping that President Biden’s efforts to transform the judiciary and make it more liberal would pay off for them and a judge would let this slide.
But they ended up facing a judge who has a history of respecting the Second Amendment and the constitutional rights of Americans.
That judge handed down a ruling effective in Texas, Louisiana, Mississippi, and Utah, that shattered their dreams of rolling through those four states and grabbing guns.
Now there is panic at the ATF as they try to find an alternate way.
According to CNN, “A federal judge has temporarily blocked the Biden administration from enforcing a federal rule in four states that requires people who sell firearms online and at gun shows to conduct background checks on their potential customers.
“In a preliminary injunction issued Tuesday, US District Judge Matthew Kacsmaryk said the Bureau of Alcohol, Tobacco, Firearms and Explosives cannot enforce the rule intended to close the so-called gun show loophole in Texas, Louisiana, Mississippi and Utah.”
This is a major setback for the ATF as it forces them to expend time, money, and energy appealing this ruling to higher courts instead of rounding up gun owners throughout the country.
It is certainly going to throw a wrench into Joe Biden’s plan to make life in America for gun owners miserable.
The article continues, “The new ATF rule, which took effect May 20, seeks to close what gun control advocates have long called the ‘gun show loophole’ by increasing the requirements to obtain a federal firearms license. The more specifically define what it means to be ‘engaged in the business’ of selling firearms.
“By making the term more definitive, the Justice Department has said it aims to better regulate the market and encourage higher compliance with the federal background check requirement.”
The ATF knows that a lot of Americans sell and transfer guns privately. In the vast majority of these cases the guns are used for safe and lawful purposes.
These ordinary American citizens who are exercising their Second Amendment rights should not be subject to any kind of federal harassment.
Thankfully now, at least in the four states affected by this ruling, they will be temporarily protected from the aggressive efforts of Joe Biden’s ATF.
Hopefully the higher courts will uphold this important ruling and send a message to the ATF to back off of legal gun owners and respect the Second Amendment.
