The ATF is in a panic trying to pick up the pieces after this disaster.
They were not prepared for the ruling that was just handed down by a judge.
Now their entire anti-gun agenda is in danger after a major defeat in court.
The ATF has always been a very constitutionally questionable – to put it generously – agency of the federal government.
It was always a matter of time before they started getting smacked down by the legal system for going well beyond their constitutional scope of power.
Guns are protected in the Bill of Rights, and any judge who truly cares about protecting this country’s system of government is going to look harshly on an agency that tries to undo a core right.
The ATF is finding this out the hard way right now after their attempt to ban forced reset triggers.
The National Association for Gun Rights came after them hard in court, and they have now won multiple rounds of the legal battle.
And the ATF is scrambling to try to keep Pandora’s box from opening, fearing that this could lead to many more defeats in court.
According to The Truth About Guns, “President Joe Biden’s Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has taken another shot to the chin over the agency’s propensity to make laws rather than enforce them.
“On Thursday, a federal judge in Texas overturned the administration’s ban on forced reset triggers, which automatically return to their starting position after being pulled.
“District Judge Reed O’Connor, who has been front and center in recent decisions to rein in the rogue agency, ruled in the case National Association for Gun Rights v. Garland that ATF overstepped their bounds in classifying guns using forced reseat triggers as ‘machine guns’ under the Gun Control Act of 1968.”
The ban was yet another example of the Biden administration bullying gun owners.
They had no good reason to target forced reset triggers, and no authority to do so, but they did it anyway due to their dislike of guns.
The article continues, “In the decision, Judge O’Connor quoted extensively from the recent U.S. Supreme Court ruling tossing the bump stock ban, created by the ATF under the Trump administration and defended in court by the Biden/Harris administration.”
The Supreme Court has made it nearly impossible for agencies like the ATF to defend their activities in court, given how clear the Supreme Court has been that guns are a core constitutional right.
And while that may seem obvious to gun owners, many judges over the years have shied away from protecting gun rights, despite the clarity of the Second Amendment about how important they are.
Thankfully, Judge O’Connor was not shy about protecting the rights of American citizens to own guns and gun accessories without harassment from the federal government.
And the ATF has lost a landmark court battle that could set the stage for even more defeats in the years to come as gun owners continue to challenge them in court.
