Joe Biden’s administration has been committed to pushing gun control.
But things are starting to go awry for them.
And now Joe Biden is going to be furious over one court decision about gun control.
America has become so polarized that on hot-button issues like gun control, the outcome of court cases can unfortunately depend on which judge hears the case.
This is not how the judicial system is supposed to operate, as judges are intended to be neutral and objective arbiters of the law.
But frequently the laws are written in a convoluted enough way that a judge with a strong political leaning can piece things together in whichever way they want to achieve their intended outcome.
Many liberal judges do that with gun control to justify upholding gun control bills that are plainly unconstitutional.
But there are also some conservative judges who are willing to defend the Second Amendment and strike down bills that violate the freedoms of gun owners.
That is what just happened in Oregon, in a case that will be a major blow to the gun control lobby and could have reverberations all the way to Washington.
According to KGW8 News, “Though Measure 114 is not on this November’s ballot, the controversial gun control law is still in the ether. The voter-approved law has never taken effect, having been mired in series of court challenges ever since it passed two years ago.
“This week, arguments to try and revive the law were presented to a panel of judges at the Oregon Court of Appeals.”
While the law was passed at the state level, it mirrors efforts that Joe Biden has been attempting to enact at the federal level.
As such, it is part of the national push for gun control that Democrats are engaged in.
The article continues, “Oregonians narrowly passed Measure 114 the first time around, back in 2022, with 50.7% voting ‘yes.’ The law states that a gun’s magazine cannot hold more than 10 rounds, establishes that prospective gun owners must receive a permit to buy a gun, and requires a gun safety class to get that permit. The law also keeps the gun from being given to a buyer until after a background check is finished.”
“In Dec. 2022, a month after the law passed, two gun owners in Harney County in eastern Oregon filed a lawsuit to block it — and it’s been on hold ever since.”
While Oregon gun owners are likely nervous, as this law is still hanging over their heads though it is not currently being enforced, the issues this law has had in court is a real problem for Joe Biden.
If he tries to push gun control during his lame-duck session in the White House, he may run into similar issues in court that prevent him from doing what he wants to do.
Democrats and the gun control lobby are running into some serious issues in Oregon that are harming their efforts to chip away at the Second Amendment.
