A judge has gone rogue and betrayed the Constitution.
He refused to do his job protecting the Second Amendment rights of citizens.
And he unleashed the ATF on Americans in a horrific ruling.
Judges are not supposed to interject their own personal views on various issues into the rulings that they make concerning core constitutional rights.
If they do that, they are in the wrong profession, seeing as the role of a judge is to adjudicate the law, not to write brand new ones.
The Second Amendment is clearly the law of the land. Despite anti-gunners’ attempts to reinterpret it, the text of the amendment states plainly that “the people” have a right to “keep and bear arms.”
Judge James M. Moody, Jr., however, doesn’t seem to care much about what the amendment actually says, since he has a partisan agenda.
Moody is an Obama appointee who recently oversaw a case against the ATF’s unconstitutional new rules about gun sales.
Instead of striking the law down, as the Constitution would require him to do, he dismissed the lawsuit and sided with the Biden administration.
According to KARK Little Rock, “A U.S. district judge in Little Rock dismissed a lawsuit Attorney General Tim Griffin filed against the Bureau of Alcohol, Tobacco, Firearms and Explosives over a gun sales rule change.
“In the decision, the judge argued the lawsuit should have been filed in Kansas where the plaintiffs reside. The judge’s Friday order transferred the case to Kansas.”
Of course, if the lawsuit were on an issue that he agreed with, it’s hard to imagine that he would have dismissed it for the same reasons.
Surely Barack Obama knew that he didn’t like guns when he appointed him to the bench.
A separate article from KARK on the dismissal of the lawsuit goes on to say, “The decision by United States District Judge James M. Moody Jr. found the case filed in the Eastern District of Arkansas was without standing. Since those who filed the motion for a preliminary injunction were in Kansas, the case was transferred to the United States District Court of the District of Kansas, Moody wrote in his decision.”
“At issue was a change to the ruling for gun dealers by the ATF. The rule removes the requirement that selling guns must be a primary source of income for firearms sellers, changing it to anyone who sells guns for a profit must have a federal firearms dealer’s license.”
Like most Democrats, Moody clearly seems to want guns out of society, in spite of the clear words of the document that he took an oath to protect.
Now he is misusing his power from the bench to uphold gun laws that deprive American citizens of their rights.
Hopefully a higher court will reverse Moody’s mistake and protect Arkansans from the harassment of Joe Biden’s ATF.
If they fail to do that, then it will embolden more governmental agencies to crack down on core constitutional rights across the entire country.
